KATHMANDU: The Supreme Court is set to hear a writ suit challenging the announcement of KP Sharma Oli as the new Prime Minister of the nation. The hearing will take place on Sunday and it will be conducted by Justice Bal Krishna Dhakal. The case was filed by human rights advocates Khagendra Chapagain, Shailendra Gupta, and Deepak Adhikari to state that Article 76(3) of the Constitution should have been followed in order to assert the appointment of another prime minister and revoke Oli’s move.
The petitioners further claim that Oli was improperly nominated by President Ram Chandra Paudel under Article 76 (2). This was done because previous Prime Minister Pushpa Kamal Dahal was unable to secure a vote of confidence in the House of Representatives. The petitioners argue that this was a suitable time to use Article 76(3), which requires the leader of the majority party in parliament to appoint a new Prime Minister.
The case highlights a procedural dispute, with the petitioners arguing that the appointment process did not adhere to constitutional requirements. They believe that the appointment should have reflected the parliamentary dynamics following Dahal’s loss of confidence.
The House of Representatives, the Secretariat of Parliament, the Office of the President, the Office of the Prime Minister, and the Council of Ministers are among the defendants named in the petition. The outcome of this case by the Supreme Court may have a big impact on Nepal's politics as it stands right now.
