KATHMANDU: President Ramchandra Poudel has taken a proactive step in convening constitutional experts to navigate the process of forming a new government following Prime Minister Pushpa Kamal Dahal's unsuccessful bid to secure a vote of confidence. The Nepali Congress and CPN-UML alliance, now positioned to form the new government, anticipates CPN-UML Chairman KP Oli assuming the role of Prime Minister.
The Office of the President has disclosed that President Poudel has invited constitutional experts such as Dr. Bhimarjun Acharya, Bipin Adhikari, Harihar Dahal, Shambu Thapa, and Gopal Krishna Ghimire for a deliberation scheduled at 6 PM today. The experts are expected to discuss the constitutional provisions relevant to the formation of the new government.
A key point of contention among the experts revolves around the interpretation of constitutional articles. Some argue in favor of Article 76 (2), which stipulates that the leader of the party with the majority in the House of Representatives should be appointed Prime Minister. This interpretation would likely lead to KP Sharma Oli assuming office.
Conversely, others advocate for Article 76 (3), which allows the President to appoint as Prime Minister a member of the House who can command majority support. This alternative interpretation could potentially pave the way for Sher Bahadur Deuba, the President of the Nepali Congress, to ascend to the Prime Ministership.
