KATHMANDU: The Armed Police Force (APF) personnel service term limit of thirty years has not been lifted by the Supreme Court (SC) with an interim order. The choice was decided on Tuesday during a hearing on a writ suit that twelve APF officers, including Durga Prasad Bhattarai, the Deputy Inspector General (DIG), had submitted. Instead of granting the temporary remedy, the court ordered the defendants to show reason.
The APF officials, who are set to retire on Bhadra 16 due to the service term limit, had sought to overturn the 30-year cap. With the court’s refusal to issue an interim order, these officials will proceed with their scheduled retirement. The petitioners also include Senior Superintendent of Police (SSP) Bishwa Kumar Bhattarai and other senior officers.
In a previous case, the Supreme Court had issued an interim order for Nepal Police personnel, suspending the 30-year service term limit and allowing affected officers to continue their duties. This contrast in judicial responses highlights the differing approaches to similar issues within the two forces.
